1. Agreement to Terms

By accessing or using VSCodeRank ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service. We reserve the right to modify these Terms at any time, and your continued use of the Service constitutes acceptance of any changes.

2. Description of Service

VSCodeRank is a SaaS tool that:

• Tracks VS Code extension rankings in the Visual Studio Marketplace
• Monitors competitor extensions
• Provides historical analytics and reporting
• Sends email alerts for ranking changes

The Service uses publicly available data from the VS Code Marketplace API. We do not guarantee the accuracy, completeness, or availability of this data.

3. Account Registration

You agree to:

• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access
• Be responsible for all activities under your account
• Not share your account with others
• Be at least 13 years old to use the Service

4. Subscription Plans & Payment

4.1 Plans

We offer Free and Pro subscription plans. Plan features and limits are described on our pricing page and may be changed at our discretion with notice.

4.2 Payment

• Pro subscriptions are billed monthly in advance
• Payments are processed securely through Stripe
• You authorize us to charge your payment method on a recurring basis
• Prices are in USD ($) unless otherwise stated
• All fees are non-refundable except as required by law

4.3 Refund Policy

All fees are non-refundable except as required by law. You may cancel your subscription at any time, and access continues until the end of the current billing period.

4.4 Cancellation

• You may cancel your subscription at any time through the billing portal
• Cancellations take effect at the end of the current billing period
• You retain access to Pro features until the end of the paid period
• Upon cancellation, your account reverts to the Free plan
• Historical data is retained but access may be limited by Free plan restrictions

5. Data Retention & Downgrades

5.1 When You Downgrade to Free

If you cancel a Pro subscription or it expires:

• Data is NOT deleted - All your extensions, keywords, competitors, and historical data remain in our database
• Access is limited - You can only view data within Free plan limits (1 extension, 5 keywords, 30-day history)
• Competitor data is hidden - Free plan does not include competitor tracking access
• Extended history is hidden - You can only view the last 30 days (vs. 90 days on Pro)
• Data is recoverable - If you re-upgrade to Pro, all your data becomes accessible again

5.2 Account Deletion

If you permanently delete your account, all data (extensions, keywords, rankings, competitors) is permanently deleted within 30 days and cannot be recovered.

6. Acceptable Use Policy

You agree NOT to:

• Use the Service for any illegal or unauthorized purpose
• Attempt to gain unauthorized access to our systems
• Reverse engineer, decompile, or disassemble the Service
• Use automated scripts to abuse our API or scraping functionality
• Resell or redistribute the Service without permission
• Violate any laws or regulations in your jurisdiction
• Track extensions you do not own without legitimate purpose
• Spam, harass, or abuse other users or our support team

7. Intellectual Property

The Service, including its design, code, features, and content, is owned by VSCodeRank and protected by copyright, trademark, and other intellectual property laws.

You retain ownership of your data (extension information, keywords). We do not claim ownership of marketplace data, which is publicly available and sourced from the VS Code Marketplace.

8. Service Availability & Disclaimers

8.1 Availability

We strive to provide reliable service but do not guarantee 100% uptime. The Service may be unavailable due to maintenance, updates, or circumstances beyond our control.

8.2 Third-Party Dependencies

The Service relies on the VS Code Marketplace API, which is controlled by Microsoft. We are not responsible for changes, restrictions, or downtime of this API. If the API becomes unavailable, we will attempt to find alternative solutions but cannot guarantee service continuity.

8.3 Data Accuracy

We make reasonable efforts to provide accurate ranking data but do not guarantee accuracy, completeness, or timeliness. Rankings may differ from manual checks due to caching, API delays, or marketplace changes.

8.4 Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST DATA, OR BUSINESS INTERRUPTION, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRIOR TO THE EVENT GIVING RISE TO LIABILITY.

10. Termination

We reserve the right to suspend or terminate your account:

• For violation of these Terms
• For non-payment of subscription fees
• For abusive or fraudulent activity
• If required by law
• At our discretion with 30 days' notice

Upon termination, you lose access to the Service. We may retain data as required by law or for legitimate business purposes.

11. Governing Law

These Terms are governed by the laws of the European Union and the country in which we operate. Any disputes shall be resolved in the courts of that jurisdiction.

12. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes via email or by posting a notice on the Service. Your continued use after changes constitutes acceptance. If you do not agree to the changes, you must stop using the Service and may cancel your subscription.

13. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
